To marry in the UK, UK Immigration recently called for an application for a Certificate of Approval for people with no legal immigration status irregardless of whether the other partner to the relationship was a holder of settled status or a British citizen. When the application for a certificate of approval was at first introduced there was a cost payable along with the application however due to legal complications to UK immigration law, the government first eliminated the administrative charge and now candidates only need to complete the form, and supply the necessary information and send the application form.

The fact that the application is approved does not mean an automatic modification to someone?s immigration status as UK immigration law never meant that the obligation would provide any form of legal status on the ?illegal immigrant? although once granted the marriage in itself could be a ground for making an application to the immigration regulators.

The next step would be for an individual to apply for a spousal visa once the marriage is finalised. For a spouse that needs to join either their husband or wife in the uk there are new English language specifications for visa applicants which was announced in November 2010.

Besides the existing requirements for a spouse, civil partner, fianc?, fianc?e or proposed civil partner?s wanting to join either their husband, wife or civil partner in the uk. The UKBA has introduced an added prerequisite for visa applicants joining their spouse in the United Kingdom. The existing requirements for applicants are that;

? they?re arriving to reside permanently in the UK
? they?re not under 21
? are legally wed to 1 another or are in a civil partnership recognised in the UK
? that their husband, wife or civil partner is present and settled in the united kingdom
? they both intend to live together permanently as husband and wife or as civil partners
? they have met each other before

A lot of people believe that the immigration regulations are fairly tight and normally not fair in this area. Even so, believe it or not but immigration marriage scams aren?t unheard of and take place a lot more than a lot of us think.

An immigration marriage scam or sham marriage, simply represents a marriage where the partners aren?t an real couple but are going ahead with the wedding so that one of the parties can receive a visa to allow them to remain in the UK.

There can even be a lot of revenue involved in immigration marriage scams, with most not long ago an UK vicar getting caught up in the act. Due to this, it is acceptable that the Home Office enforces such strict immigration marriage protocols to guarantee that those weddings where a visa is issued is a legitimate relationship ? it is not to persecute individuals but merely point out those whose relationship is a sham.
